A building permit is required to install, move or construct any shed in Montgomery County. A Zoning review for the proposed location of the shed is required. A Site Plan showing the proposed location of the shed must be submitted electronically.
A one-story shed, with a floor area of 200-square-feet or less, does not require a structural review. All other sheds require a set of construction plans, drawn to scale (min ¼” to 1’), to be submitted with the Site Plan.
After a shed is installed, a final inspection to verify the proper location and anchorage is required.

If a code violation is reported at your property, an inspector will order the appropriate corrective action which may include obtaining a permit.
In some circumstances, electrical , mechanical , public right-of-way , well and septic , and/or fire protection permits are required to complete the project. You will also need to make sure that your project conforms to Zoning requirements.
Many of the subdivisions and developments in Montgomery County have private deed restrictions and covenants regulating construction. The County does not enforce covenants and deed restrictions. You may obtain information from your homeowner’s or civic association. You may also need a permit or other permission if you live a Montgomery County municipality that requires it.
Applications for single story sheds with a floor area of 200 square feet or less may be processed via our Fast Track program.
Applications for multi-story sheds, and those with a floor area greater than 200 square feet, will be reviewed through the regular review process. Additionally, these sheds may require footing and framing inspections in addition to the final. For adequately prepared applications, it takes up to 17 days to issue the permit.

Homeowners may apply for a building permit in their own name; however, if a contractor is to perform the work, DPS strongly suggests that the contractor be listed on the permit as the party responsible for the work. A contractor must have a Maryland Home Improvement Commission (MHIC) license to obtain a permit.
Any dispute as to whether a shed has extended into a neighbor’s property or questions about the location of property lines is a legal matter to be resolved by the property owners.

Permits must be applied for electronically via Apply Online. Electronic permit applications can be made at any time. Unless exempt by State law, a non-refundable filing fee must be paid at application. Acceptable methods of payment are credit card, electronic check or via escrow. Sheds less than 200-square-feet do not require plan review. For sheds over 200 square feet, your drawings and documents will be reviewed for compliance with local and state building codes. If the plan reviewer determines that your documents are adequate they will stamped as DPS approved for code compliance. If your drawings and documents need corrections, you will receive a notification that corrections are required. Once those corrections are made please upload your corrected information in accordance with the ePlans submittal requirements noted in process box 2. A site plan or house location survey showing the location of the shed, along with setback distances, must be included regardless of whether construction plans are required.
You may pay your permit fee online, by mail, or in-person at the DPS office. Your permit will not released to you until all DPS permit fees are paid. To pay electronically use the Pay Online link in the process box and log in into your account, then select the Make Payment option.
After all fees are paid and all other requirements are satisfied, the permit technician will issue the permit. Hard copies of permits and approved drawings and documents may be picked up at DPS offices. If submitted electronically, the permit and approved drawings and documents will be provided to the applicant electronically. Hard copies of the drawings and documents must be available for the inspector at the job site.
All work must conform to the approved drawings and documents or revised approved drawings and documents. The permit must be kept on site and available to DPS inspectors until completion of the project.
Inspections shall be requested at least 24 hours prior to the date the inspection is needed. Inspections, except partial inspections, may be scheduled online using the Inspection Requests link in the process box. You will need the type of permit, permit number and the Contact ID number printed in the top right corner of your permit.
To request a permit revision, you must follow Steps 1 though 4. Revisions should detail what is being changed with square footage of the changed area or changes in the cost of construction included. Revision fees must be calculated by DPS staff. Once the fees are calculated you will be able to pay them online or by mail or in-person at the DPS office.
